Agreement to Terms
Welcome to Land Surveyor App ("App," "we," "us," or "our"). These Terms of Service ("Terms") govern your use of our mobile application and related services. By downloading, installing, or using the Land Surveyor App, you agree to be bound by these Terms.
If you do not agree to these Terms, please do not use the App. We reserve the right to update these Terms at any time, and continued use of the App constitutes acceptance of updated Terms.

What you can and cannot do with the App
License Grant
We grant you a limited, non-exclusive, non-transferable, revocable license to:
- Download and install the App on your personal device(s)
- Use the App for personal or professional surveying calculations
- Export and save calculation results for your projects
- Use the AI Assistant feature (if you choose to set it up)
Restrictions
You may NOT:
- Reverse engineer, decompile, or disassemble the App
- Modify, adapt, or create derivative works of the App
- Redistribute, resell, or sublicense the App
- Remove or alter any proprietary notices or labels
- Use the App for any illegal or unauthorized purpose
- Share your OpenAI API key with others through the App
- Attempt to extract or scrape calculation algorithms
AI Assistant - Specific Terms
Important terms for the optional AI Assistant feature
Optional Feature
The AI Assistant is completely optional. The core surveying tools work independently without it. You choose whether to set up and use this feature.
Your API Key Required
To use the AI Assistant, you must:
- Create your own OpenAI account
- Obtain your own OpenAI API key
- Enter your API key in the App's AI Setup screen
- Accept OpenAI's Terms of Service and Privacy Policy
We do not provide API keys or OpenAI accounts.
Costs and Billing
You are solely responsible for all costs associated with OpenAI API usage, including:
- OpenAI API usage charges based on your conversations
- Any overage or rate limit fees from OpenAI
- Monitoring your usage in your OpenAI account dashboard
- Setting usage limits in your OpenAI account if desired
We do not charge any fees for the AI Assistant feature. All costs come directly from OpenAI and are billed by them to you.
Data and Privacy
When you use the AI Assistant:
- Your messages are sent to OpenAI's servers for processing
- OpenAI's Privacy Policy and Terms govern their data handling
- We never see or store your API key on our servers
- Conversation history is stored locally on your device
- You can clear conversation history anytime

AI-generated responses are for informational purposes only:
- Not Professional Advice: AI responses do not constitute professional surveying advice

Third-Party Terms
By using the AI Assistant, you agree to comply with:
Violations of OpenAI's terms may result in your API key being disabled by OpenAI.

You maintain complete control:
- Remove your API key anytime from AI Setup screen
- Clear conversation history whenever you want
- Stop using the feature without affecting other app functionality
- No penalties or restrictions for not using AI Assistant

You are responsible for verifying all calculations and results before using them in professional work. This app is a calculation tool, not a replacement for professional judgment and expertise.
Compliance with Laws

Data Accuracy
Verify that all input data you enter is accurate. The App's calculations are only as good as the data you provide. Garbage in, garbage out.
Appropriate Use
Use the App only for legitimate surveying and calculation purposes. Do not use it for illegal activities or to circumvent professional licensing requirements.
API Key Security
If using AI Assistant, keep your OpenAI API key secure. Do not share it with others. Monitor your usage and costs in your OpenAI account.
Backup Your Data
Maintain backups of important calculations and exported data. While the App stores data locally, device issues can result in data loss.

- Calculation Errors: Damages arising from incorrect calculations or results provided by the App
- AI-Generated Content: Damages from reliance on AI Assistant responses or suggestions
- Professional Consequences: Damages from professional errors, licensing issues, or regulatory violations related to App use
- Third-Party Services: Damages from OpenAI services, API costs, or third-party integrations
- Data Loss: Loss of saved calculations, exports, or other data stored in the App
Some jurisdictions do not allow limitation of certain damages, so some limitations may not apply to you.
Maximum Liability: In any case, our total liability shall not exceed the amount you paid for the App (if any) in the 12 months preceding the claim.

We may add, modify, or discontinue features (including AI Assistant) at any time without notice. We are not liable for any feature changes or removal.
Termination
How your access to the App can be terminated
Your Right to Terminate
You may stop using the App at any time by uninstalling it from your device. If using AI Assistant, remove your API key before uninstalling.
Our Right to Terminate
We may suspend or terminate your access to the App if you:
- Violate these Terms
- Use the App for illegal purposes
- Attempt to reverse engineer or hack the App
- Engage in fraudulent activity
Effect of Termination
Upon termination, your right to use the App immediately ceases. Data stored locally on your device will remain unless you uninstall the App.
Governing Law and Disputes

Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where APPNEST operates, without regard to conflict of law principles.
Dispute Resolution
Any disputes arising from these Terms or App use shall be resolved through good faith negotiation. If negotiation fails, disputes shall be resolved in the courts of competent jurisdiction.
Limitation Period
Any claim or cause of action arising out of your use of the App must be filed within one (1) year after such claim or cause of action arose, or it will be forever barred.
